The baby was immediately transported to Norman Regional Hospital Healthplex and subsequently airlifted to OU Children’s Hospital due to the gravity of his condition. Despite the medical team's valiant efforts, the infant succumbed to his injuries approximately twelve hours later, his tiny body bearing multiple skull fractures.​

In her initial account to the authorities, Kristeny claimed that she had left her two children unattended for a brief period, approximately three to four minutes. Upon her return, she discovered her infant son injured, lying in a small ball pit within their apartment. (A ball pit is a padded container or area filled with colorful, soft, plastic balls, typically found in children's play areas like play centers, daycares, and even at home, offering a fun and safe space for kids to play and explore.) She suggested that her four-year-old son might have accidentally caused the injuries by throwing the baby into the ball pit, an activity she had purportedly witnessed before without incident.

Upon initial interview, the defendant stated that she only left OS unattended with his 4-year old brother (hereinafter referred to as "HD") for 3-4 minutes, before finding OS injured and laying in a small ball-pit. The defendant also described an incident that occurred the day before, where she witnessed HD throw OS into that same ball-pit, although OS was not injured at that time. The defendant further explained that HD would frequently jump into the ball pit from nearby furniture.

However, this narrative soon unraveled under the scrutiny of the investigation.​

Further inquiries revealed a more troubling scenario. Kristeny admitted to consuming alcohol throughout that fateful day, starting as early as 9 a.m. with the purchase of a pint of whiskey. Her intoxication impaired her ability to perform routine tasks, prompting her to request her boyfriend to pick up their four-year-old from daycare. Despite her inebriation, she eventually decided to retrieve her son herself, purchasing another bottle of whiskey en route.

Investigations showed that the defendant purchased a pint of whiskey at 0900 hours this day and another pint of whiskey at approximately 1530 hours as she drove to get HD from daycare.

Upon returning home, she reportedly passed out for approximately ninety minutes, leaving the children unsupervised during this critical period. It was during this time that the infant sustained the fatal injuries, the exact circumstances of which remain uncertain.​

The Norman Police Department arrested Kristeny N. Davis on February 5, 2025, in connection with her son's death. She was charged with second-degree murder, predicated on allegations of child neglect leading to the infant's demise. Bodycam footage from the arrest depicts a distraught Kristeny, with her boyfriend apologizing for her behavior and indicating her continued intoxication. She was subsequently detained at the Cleveland County Detention Center, with bond set at $1 million. Court records indicate that a preliminary hearing conference is scheduled for March 18, 2025.​
