The incident occurred in Cherokee County, northeast Alabama. The victim was William Clinton Clayton, Jr., a delivery driver. On March 6, 1998, Clayton stopped at an ATM to withdraw money, most likely to take his wife out to dinner. At this point, Gavin approached the vehicle. Gavin attempted to rob Clayton and, during the confrontation, shot him in his van. Witnesses said Gavin shot Clayton before stealing the van. An autopsy later revealed that Clayton had three gunshot wounds from two bullets. An investigator from the district attorney's office was present when the shooting occurred and pursued the stolen van. Gavin came to a halt in his van, fired at the investigator, and then fled. He was apprehended shortly.
Due to the tragic incident, Gavin was found guilty of capital murder and sentenced to death. His execution date is set for July 18, 2024.
