Harvey Earvin (b. 1958 | age 65) was convicted in the December 1976 robbery and slaying of Ertis Brock, 75, a Lufkin, TX service station attendant. Court records indicate that Harvey, wearing an Afro-type wig and cosmetic mustache and his 15-year-old girlfriend went to the rear of a filling station to rob Brock of the cash he had collected during the day, Harvey, armed with a 20-gauge shotgun, told Brock to stop upon seeing him carrying cash bags to his car and then shot the attendant in the chest when he reached into his back pocket. Harvey told police he thought Brock was reaching tor a gun. Harvey ran from the scene, dropping his gun and leaving the cash bags behind. Harvey later laughed and joked about the murder to friends and cellmates.i

XD: After learning of his execution date of May 14, 1986, Earvin filed two separate applications for writ of habeas corpus and motions for stay of execution, which were both denied by the Texas Court of Criminal Appeals.
Harvey Earvin was sentenced to death by the State of Texas for a robbery and murder committed in 1976. According to court documents Harvey would rob a gas station where he would shoot and kill the clerk. Harvey would be arrested, convicted and sentenced to death. Harvey has been on death row for over 47 years.i
A jury convicted Harvey Earvin of capital murder on August 25, 1977, and sentenced him to death. On Nov. 10, 1988, “We affirm the district court's decision denying Earvin habeas corpus relief. Earvin failed to prove his counsel was so deficient that he was denied effective assistance of counsel at the penalty stage of his trial. Further, he failed to prove any prejudice from the actions of his counsel justifying relief from this Court.”ii
After learning of his execution date of May 14, 1986, Harvey filed two separate applications for writ of habeas corpus and motions for stay of execution, which were both denied by the Texas Court of Criminal Appeals. However, a new execution date has not been set.
