… on September 1, 2001, a plumbing contractor working in the Andrew home overheard Brenda tell Rob that "she was going to have him fucking killed" In addition, Jim, who had served in the military, was often heard to brag about his involvement in top secret missions. The SCOTUS rejected the appeal of Oklahoma death row inmate James Pavatt [hereinafter referred to as (“Jim”); b. November 10, 1953 | age 70], who helped his girlfriend kill her husband in Oklahoma City in 2001.
Jim, 70, has exhausted his appeals in the case and is now the 26th inmate eligible for an execution date when the state resumes executions.
Jim and Brenda Andrew (“Brenda”) were convicted separately of conspiring to kill and killing Rob Andrew to get the proceeds of an insurance policy.
Brenda was estranged from her husband at the time, and she and Jim were having an affair.
Rob Andrew, an advertising executive, was shot in his garage as he came to his old house to pick up his children for the Thanksgiving weekend.
Jim and Brenda Andrew were caught crossing back into the United States from Mexico months later. Both were given the death penalty.
In his petition to the SCOTUS, Jim argued that the 10th U.S. Circuit Court of Appeals should have heard his challenge to the constitutionality of Oklahoma’s law that allows prosecutors to seek the death penalty when the killing was “especially heinous, atrocious or cruel”.
The Oklahoma attorney general’s office told justices they should decline Jim’s “invitation to second-guess the Tenth Circuit’s rulings on these procedural matters. In any event, the Tenth Circuit’s determinations were correct.”
Without comment, the justices declined to review the 10th Circuit decision.
Oklahoma has not executed an inmate since 2015. In 2018, the state abandoned lethal injection as its execution method and has been exploring the use of nitrogen gas.i
Jim and the Andrews attended the same church, and Jim and Brenda taught a 5th and 6th grade Sunday School class together. It is not surprising then that it was at church where relationship issues first came to light. Church members noticed Brenda dressing inappropriately and acting inappropriately with Jim, who was also married at the time. As a result, on September 19, 2001, Jim and Brenda were asked by church leaders to step down from their teaching positions. Both Jim and Brenda were upset by this. Brenda was upset that Rob would not defend her and/or leave the church over it. Jim felt that Rob was involved behind the scenes. Right after it happened, Jim, referring to Rob, told a church member, "I hate the son of a bitch". More at Pavatt v. Trammell, Case No. CIV-08-470-R | Casetext Search + Citator (2014).
